How Does the Asylum Process Work?

An asylum application is based on your being unable or unwilling to return to your home country because of past persecution or a fear of future persecution. To qualify, the persecution must be based on one of five protected grounds:

  • Race
  • Religion
  • Nationality
  • Membership in a particular social group
  • Political opinion

There are two primary procedural paths:

  • Affirmative asylum. Filed with U.S. Citizenship and Immigration Services (USCIS) by individuals who are not in removal proceedings. This process includes a non-adversarial interview with an asylum officer.
  • Defensive asylum. Raised as a defense in removal proceedings before an immigration judge. This is an adversarial process where the government may challenge your claim, and evidence and testimony are presented in a trial-like setting.
