Marriage Immigration Pathways We Handle in Lincoln

K-1 Fiancé Visa

The K-1 fiancé visa allows the foreign-citizen fiancé(e) of a U.S. citizen to travel to the United States for the purpose of marriage. The couple must marry within 90 days of arrival. After the wedding, the foreign spouse applies for adjustment of status to obtain lawful permanent residence. Only U.S. citizens may sponsor a K-1. Lawful permanent residents must use spousal or other family-based immigrant visa categories instead. We handle the full petition process, from initial filing through the subsequent adjustment of status application (Form I-485).

Spouse Visa & Consular Processing

For couples who are already married and the foreign spouse is living abroad, the CR-1 or IR-1 spouse visa routes the case through a U.S. consulate overseas. The IR-1 applies when the marriage is two or more years old at the time of admission and results in immediate permanent residence; the CR-1 applies to marriages under two years and results in conditional permanent residence. When a marriage-based green card is approved for a couple married less than two years, USCIS issues conditional permanent residence valid for two years rather than a standard 10-year green card. To remove those conditions and obtain full permanent residence, the couple must jointly file Form I-751 within the 90-day window before the conditional card expires.
