K-1 Eligibility Requirements

• IMBRA compliance: The International Marriage Broker Regulation Act requires background checks on K-1 sponsors and generally limits a petitioner to sponsoring a K-1 fiancé visa twice, with at least two years between sponsorships absent a waiver.

The K-1 Visa Process, Step by Step

The K-1 process moves through several federal agencies before the fiancé(e) can travel to the United States. Processing times vary and can span many months across those agencies, so starting early matters.

Filing Form I-129F with USCIS

The U.S. citizen petitioner files Form I-129F, Petition for Alien Fiancé(e), with USCIS. This petition establishes eligibility and begins the federal review. Strong bona fide relationship evidence, including photographs, communication records, and proof of in-person meetings, is assembled at this stage.

National Visa Center & Consular Processing

Once USCIS approves the I-129F, the National Visa Center assigns a case number and forwards the file to the U.S. embassy or consulate in the fiancé(e)’s home country. The fiancé(e) then completes Form DS-160, undergoes a required medical exam, and attends a consular interview. If approved, the K-1 visa is issued for a single entry and generally valid for up to six months.

After Arrival: Marriage & Adjustment of Status

The couple must marry within 90 days of the K-1 holder’s entry into the United States. After the wedding, the foreign spouse files Form I-485 to apply for lawful permanent residence. If the marriage is less than two years old when residence is granted, the foreign spouse receives conditional permanent residence and must later file Form I-751 to remove those conditions before the two-year card expires. For Nebraska residents, adjustment of status interviews and decisions are handled through the USCIS Omaha Field Office.
