The Three EB-1 Subcategories

The EB-1 classification covers three distinct pathways, each with its own qualifying criteria and sponsorship requirements.

EB-1A: Extraordinary Ability

EB-1A is available to individuals with sustained national or international acclaim in sciences, arts, education, business, or athletics. No job offer or employer sponsor is required, making this a self-petition option. To qualify, an applicant must satisfy at least three of ten USCIS evidentiary criteria, or demonstrate receipt of a major one-time international award such as a Nobel Prize.

EB-1B: Outstanding Professor or Researcher

EB-1B is for professors and researchers with at least three years of experience and international recognition in their field. A sponsoring employer is required and must have a qualifying permanent research position available. This category requires satisfying at least two of six defined evidentiary criteria.

EB-1C: Multinational Executive or Manager

EB-1C applies to managers or executives transferring to a U.S. affiliate, subsidiary, or parent company where they worked for at least one of the past three years. An employer sponsor is required. All three EB-1 categories are exempt from PERM labor certification, which is required for most other employment-based green card paths and can add years to the process.
