Polaris Law Group EB-1 Visas

EB-1 Visa Attorney in Chicago

Match Your Record to the Right EB-1 Pathway

The EB-1 employment-based immigrant category includes three distinct pathways: extraordinary ability, outstanding professor or researcher, and multinational executive or manager. Eligibility depends on how an individual’s achievements, employment history, evidence, and intended U.S. work align with the requirements of a particular category.

Our EB-1 visa lawyers provide individualized guidance to professionals and employers facing these complex questions. A prominent title, advanced degree, publication record, or temporary work status doesn’t establish eligibility by itself. We review the full record before recommending a potential path forward.

Call (402) 383-2698 to discuss your qualifications, supporting evidence, and potential path toward permanent residence.

How EB-1A, EB-1B, & EB-1C Differ

Each category has distinct rules for petitioners, job offers, employment history, and supporting evidence. Identifying the appropriate path early clarifies what information must be collected and how the petition should be structured.

EB-1A Extraordinary Ability

EB-1A is for individuals who can demonstrate sustained national or international acclaim in the sciences, arts, education, business, or athletics and intend to continue working in their field. It doesn’t require a specific job offer or employer petitioner, so a qualifying individual may file on their own behalf.

EB-1B Outstanding Professor or Researcher

EB-1B applies to professors and researchers who are internationally recognized in a particular academic field and are entering a qualifying teaching or research position. A qualifying U.S. employer must file the petition, making the offered role and the employer’s documentation central to the analysis.

EB-1C Multinational Executive or Manager

EB-1C may be available to certain executives and managers who have qualifying employment with a foreign organization related to the petitioning U.S. employer. We examine the individual’s overseas employment, the relationship between the organizations, and whether the proposed U.S. position meets the managerial or executive requirements.

How an EB-1 Visa Attorney Builds the Evidence Record

A persuasive filing requires more than a collection of impressive documents. The evidence should present a consistent account of extraordinary ability, academic recognition, or qualifying multinational employment while addressing the USCIS requirements for the selected category.

An EB-1 case commonly involves these stages:

  • Category assessment: We examine the person’s background, proposed U.S. work, petitioner requirements, and available records.
  • Evidence development: We organize relevant professional, academic, employment, and organizational documents around the chosen classification.
  • Immigrant petition: We prepare and submit Form I-140, the Immigrant Petition for Alien Workers, with the supporting materials.
  • Government follow-up: If USCIS issues a Request for Evidence, we prepare a response addressing the questions raised.
  • Permanent residence stage: Depending on the applicant’s location and visa availability, the next step may be adjustment of status in the United States or consular processing abroad.

Processing times, filing order, visa availability, premium processing options, and immigration policies can change. We review current government guidance and the facts of the case before recommending a filing strategy. No general timeline can account for every petition or later Green Card stage.

Former Government Attorneys & Multilingual Immigration Guidance

Attorney Tasha Afkhamnejad has extensive immigration law experience that includes complex visa matters and employment-based cases. Our team also includes former government attorneys and lawyers with federal immigration enforcement experience, offering valuable perspective when preparing detailed filings.

We shape each strategy around the client’s qualifications, employer needs, and current immigration rules. Clear explanations, responsive communication, and ongoing updates allow individuals and businesses to make informed decisions throughout the process.

Our multilingual staff speaks Spanish, Farsi, Hindi, Gujarati, Russian, Ukrainian, Italian, Portuguese, Arabic, Q’anjob’al, and Punjabi. Clients can share important details and discuss the legal process in a language they’re comfortable using.

Nationwide Immigration Representation From Our Chicago Office

Polaris Law Group has an office in Chicago and represents immigration clients nationwide through offices in Chicago, Lincoln, Columbus, and Omaha. Because immigration law is federal, there isn’t a separate local eligibility standard. A case may involve an applicant, employer, academic institution, affiliated company, or supporting evidence located elsewhere.

Clients seeking an EB-1 visa lawyer in Chicago may need to coordinate employment records, academic materials, professional evidence, translations, and overseas documents. We remain involved through preparation and filing while explaining potential next steps toward an employment-based Green Card.

Get a Focused Review of Your EB-1 Options

We work with prospective applicants, petitioners, and employers to identify the potentially relevant category, evaluate the available evidence, and determine what additional information may be needed. Confidential office and virtual consultations are available. Any eligibility assessment or filing strategy depends on the individual facts, current USCIS rules, and visa availability.
