Polaris Law Group EB-2 Visas

EB-2 Visa Attorney in Chicago

Choose the Right EB-2 Petition Path

The EB-2 immigrant visa category offers two routes for professionals with advanced qualifications. At Polaris Law Group, we guide Chicago individuals and employers through eligibility analysis, petition preparation, and the permanent residence process.

The standard route requires employer sponsorship and PERM labor certification for a permanent position. A National Interest Waiver allows a qualifying individual to self-petition without an employer sponsor or that certification process.

We also develop employment-based immigration strategies for employers in sectors that include:

  • Startups
  • Technology companies
  • Agriculture producers
  • Manufacturing businesses

For each case, we identify the appropriate petition pathway and organize the supporting evidence around its legal requirements.

From Form I-140 to Permanent Residence

The petition stage begins with Form I-140, which requests an employment-based immigrant classification from U.S. Citizenship and Immigration Services. The required steps depend on whether the case follows the employer-sponsored or self-petition route.

The stages are:

  • Employer-sponsored petition: The employer completes the PERM labor certification process and files Form I-140 after approval.
  • Self-petition: The applicant files Form I-140 directly without an employer sponsor or approved labor certification.
  • Permanent residence: After the petition stage, the green card process continues through adjustment of status in the United States or consular processing abroad.

Evidence That Establishes EB-2 Eligibility

The documentation must establish eligibility for the underlying EB-2 classification. The appropriate evidence depends on whether the applicant qualifies through an advanced degree or exceptional ability and whether the case includes a waiver request.

Core evidence categories include:

  • Advanced degree: Evidence can include a degree above a bachelor’s degree or its foreign equivalent. Eligibility can also rest on a bachelor’s degree or foreign equivalent followed by at least 5 years of progressive experience in the specialty.
  • Exceptional ability: The applicant must satisfy at least 3 of 6 regulatory criteria and demonstrate ability significantly above what’s ordinarily encountered in the sciences, arts, or business.
  • Waiver request: The record should describe the proposed endeavor and document its national importance. Supporting materials can address education, skills, plans for future activities, and progress already made toward the endeavor.
